1. Acceptance of Terms

By accessing or using VulneraFinder ("the Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree to these terms, you must not use the Service.

2. Description of Service

VulneraFinder is a cybersecurity intelligence platform providing vulnerability monitoring, threat detection, and security testing tools designed exclusively for defensive security purposes, authorized penetration testing, and security research. The Service is provided "as is" without warranties of any kind.

3. Authorized Use Only

IMPORTANT: DEFENSIVE AND AUTHORIZED USE ONLY

VulneraFinder and all associated tools, including but not limited to SecOps, AdverseLLM, and payload libraries, are intended exclusively for:

Defensive Security - Protecting your own systems and applications
Authorized Penetration Testing - Testing systems you own or have explicit written authorization to test
Security Research - Academic and legitimate security research purposes
Compliance Testing - Validating security controls and regulatory compliance
Red Team/Blue Team Exercises - Authorized security assessments within your organization

You must obtain proper written authorization before testing any system. Unauthorized access to computer systems is a criminal offense in most jurisdictions.

4. Prohibited Activities

You expressly agree NOT to use the Service to:

Attack, scan, probe, or test any system without explicit written authorization from the system owner
Conduct any unauthorized access to computer systems or networks
Engage in any activity that violates the Computer Fraud and Abuse Act (CFAA) or equivalent laws in your jurisdiction
Distribute malware, ransomware, or other malicious software
Engage in denial of service attacks or attempts to disrupt services
Access, steal, or compromise data belonging to others
Conduct social engineering attacks against unauthorized targets
Use the Service for any illegal or unethical purpose
Resell, redistribute, or sublicense the Service without written permission

5. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

6. Security Testing Liability

YOU ACKNOWLEDGE AND AGREE THAT:

You are solely responsible for ensuring proper authorization before any security testing
VulneraFinder provides tools; how they are used is entirely your responsibility
We are not liable for any damages, legal consequences, or harm resulting from your use of the Service
You will indemnify and hold Zero Day, Inc. harmless from any claims arising from your use of the Service

7. Intellectual Property Rights and License Restrictions

IMPORTANT: INTELLECTUAL PROPERTY ACKNOWLEDGMENT

By using VulneraFinder, you expressly acknowledge and agree that:

Proprietary Technology - VulneraFinder, including all software, algorithms, methodologies, test payloads, security testing frameworks, user interfaces, APIs, documentation, and associated intellectual property, are the exclusive property of Zero Day, Inc. and its licensors.
No Derivative Works - You may NOT create derivative works, modifications, enhancements, or improvements based on VulneraFinder technology. You expressly waive any right to iterate on, build upon, or create competing products inspired by VulneraFinder's intellectual property.
No Reverse Engineering - You may NOT reverse engineer, decompile, disassemble, or attempt to derive the source code, underlying algorithms, or architecture of the Service.
No Reproduction - You may NOT copy, reproduce, or replicate any aspect of VulneraFinder's security testing methodologies, payload libraries, or detection techniques for use in other products or services.
Trade Secret Protection - You acknowledge that VulneraFinder contains valuable trade secrets and confidential information. Any exposure to such information through your use of the Service does not grant you any rights to use, disclose, or exploit such information.
Assignment of Ideas - Any suggestions, feedback, or improvements you provide regarding VulneraFinder become the exclusive property of Zero Day, Inc. without compensation or attribution.

VIOLATION CONSEQUENCES: Any violation of these intellectual property provisions may result in immediate termination of your account, civil liability for damages, and potential criminal prosecution under applicable trade secret and intellectual property laws. VulneraFinder is a product of Zero Day, Inc.

The Service, including all content, features, functionality, trademarks, and trade secrets, is owned by Zero Day, Inc. and protected by U.S. and international intellectual property laws, including but not limited to the Defend Trade Secrets Act (DTSA), Digital Millennium Copyright Act (DMCA), and equivalent international treaties.

8. Payment Terms

Paid subscriptions are billed in advance. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days notice to existing subscribers.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VULNERAFINDER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify, defend, and hold harmless VulneraFinder and its officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account immediately, without prior notice, for any violation of these Terms or for any conduct that we determine, in our sole discretion, to be harmful to other users, us, or third parties.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use constitutes acceptance.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
